Liable for Deportation in New Zealand?

When can you be Deported?

There are a number of reasons why you may be liable for deportation from New Zealand. Some of these include:
  • If your visa expires and you don’t renew it
  • If you overstay your visa by more than 28 days
  • If you work without a valid work visa
  • If you study without a valid student visa
  • If you breach the conditions of your visa
  • If you commit a crime
  • If you are deemed to be a risk to national security

What Happens if you're Liable for Deportation?

If you’re liable for deportation, you’ll be given a notice of intention to deport. This notice will state the reasons why you’re being deported and will give you 14 days to appeal the decision.
If you decide to appeal, your case will be heard by the Immigration and Protection Tribunal. The Tribunal will then make a decision on whether or not you should be deported.
If the Tribunal decides that you should be deported, you’ll be given a date by which you must leave New Zealand. You may also be required to surrender your passport and any other travel documents that you have.
If you don’t leave New Zealand by the specified date, you may be forcibly removed from the country.
